Refund policy
- RETURNS AND REFUNDS
- Gourmet Coffee Roasters is committed to complying with applicable consumer law and will exchange or refund you subject to, and in accordance with, the provisions of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Consumer Protection Act 68 of 2008 (“CPA”).
Returns in terms of ECTA
- In terms the ECTA, where applicable, you may cancel the transaction without reason or penalty within seven days of delivery, subject to the following:
- You are a natural person and you are the end user of the products purchased.
- The products are returned to us in its original packaging and have not been used or damaged.
- We will not refund you the shipping costs if the products have already been delivered or dispatched to you.
- You will be liable for the direct costs of returning the products to us, which include shipping, repacking and/or repackaging, where applicable.
- You need to notify us of that you intend to the return to the products within seven days of delivery at returns@gourmetroasters.co.za.
Returns in terms of CPA
- In terms of the CPA, where applicable, goods are sold to you with an implied warranty of quality against defects for six months and will be useable and durable for a reasonable period of time, having regard to the use to which the products would normally be put and to all the surrounding circumstances. In the event of you receiving a product from us that is defective, please notify us as soon as possible at returns@gourmetroasters.co.za. This right is available to you for a period of six months from date of delivery of the products to you.
- Note that a product will not be considered defective, and you will therefore not be entitled to claim a refund in terms of the above, where the defect or damage has been caused by, or is as a result of, inter alia, the following:
- Your negligence, failure to maintain, failure to care or incorrect use of the product;
- Where the product requires installation or operation by a professional and this has not happened;
- Where the product has been altered or used in a manner or in conjunction with another assembly or component which does not meet, or is in contravention of, the standard recommendations and/or requirements of the particular product; and
- Resulting from normal wear and tear.
- Note that you will not be entitled to return a product in terms of the above where you were expressly informed that the product offered was in a specific condition and you expressly accepted the products in that condition, such as used products.
- In the event of a claim in terms of the above, we shall replace or repair the product or refund you the purchase price and shipping costs paid by you.
Returns subject to inspection
- Note that any return, be it in terms of the ECTA, the CPA or otherwise, shall be subject to the product being tested and inspected by us, the supplier and/or manufacturer, as the case may be, prior to any replacement, repair or refund shall be made by us.
- If the report as a result of the above testing provides that the products were misused, damaged, tampered, were of good quality, were fit for the purpose, or any other circumstance which entitled us to refuse a replacement, repair or refund, then in such an event, subject to the relevant consumer laws, we will not replace, repair or refund you.
Payment of refund
- In the event of you exercising your right to a refund in terms of the ECTA or CPA as provided above, we shall refund you the purchase price paid within thirty days of the cancellation, less shipping costs and other direct costs incurred in returning the product to us (where allowed).
Incorrect products
- In the event of you receiving the incorrect product, please notify us within 24 hours and we will replace the product with the correct product at no cost to you. Note that this provision is only applicable where the product you receive does not match the description of the product you ordered on our website.
Perishable goods
- The following perishable and frozen goods cannot be returned:
- Goods which have been supplied and delivered to you in accordance with your order;
- Goods which are unsuitable to return due to hygienic reasons;
- Goods which have expired;
- Goods which by their nature would degrade or deteriorate post-delivery.
